Man Arrested after Overnight Standoff

** Update ** Franklin is also charged with Possession of Cocaine and Possession with Intent to Distribute Marijuana. As of November 7, 2022, he remained in jail on a $150,000 bond set by a Judge.

After refusing to come out of a Wood Creek Farms home for multiple hours, a 34-year-old male suspect is in police custody.

CPD with the assistance of Agents with the South Carolina Law Enforcement Division (SLED) arrested Devon Michael Franklin without serious injury today.

Franklin is being charged with Three Counts of Pointing and Presenting a Firearm at a Person. An additional charge of Breach of Peace of a High and Aggravated Nature is forthcoming. After his arrest, he was taken to a local hospital and upon release will be housed at the Alvin S. Glenn Detention Center (ASGDC).

Case Recap:

CPD officers were initially dispatched to the 100 block of Island View Circle shortly before 4:30 p.m. yesterday (November 3, 2022) after an emergency call about an armed man threatening relatives during a domestic disturbance.

During the disturbance, armed suspect Franklin allegedly forced family members out of the home at gunpoint. The relatives were unharmed and taken to a safe location by CPD officers. Moments later, Franklin refused to surrender and come out of the home. It is believed that Franklin was under the influence of an illicit substance at the time of the conflict.

CPD crisis negotiators talked with Franklin in an effort to convince him to peacefully surrender. Partners with the Community Crisis Response and Intervention Team were also on scene. CPD SWAT members were deployed in order to secure the perimeter and prevent the escape of the suspect and effect an arrest upon surrender. Nearby residents were told to shelter in place. Access in and out of the neighborhood was strictly limited to resident only. Franklin ignored repeated attempts to negotiate with CPD yesterday and overnight.

At approximately 6:00 a.m. today, SLED’s SWAT team relieved CPD’s SWAT officers who had been overnight.

Shortly after 9:00 a.m., Franklin was taken into custody without serious injury.  Evidence suggests that the suspect discharged a firearm inside the home. No law enforcement discharged a firearm during the incident.

Chief W.H. ‘Skip’ Holbrook says, “In spite of the suspect being armed, his erratic behavior and discharging a firearm, no lethal force was used by law enforcement. CPD officers used training, restraint and outstanding tactics, placing the highest priority on preserving life during the incident. CPD officers in collaboration with our SLED partners made sure the incident did not end tragically.”

A bond hearing for Franklin is scheduled for 9:00 a.m. tomorrow (November 5, 2022) at the Municipal Court located at 811 Washington Street.

All persons arrested/charged are presumed innocent until or unless proven guilty in a court of law.
